This revision application has been filed for setting aside the Judgment and order dated 29.5.2014 passed by the 1st Additional Sessions Judge, Aurangabad, in Criminal Appeal No. 72 of 2013/03 of 2013, by which he has affirmed the order dated 23.7.2013 passed by the Judicial Magistrate, 1st Class, Aurangabad, by which he has refused to release the Petitioner in Trial No. 442 of 2013. In course of hearing of the Appellant it was learnt that the Petitioner had already remained in custody for more than the period of sentence. So a report from the Jail Superintendent, Aurangabad, was called for with a direction that he release the Petitioner immediately.

Patna High Court CR. REV. No.533 of 2014 (4) dt.22-09-2015 has been received from which it appears that the Petitioner had been forwarded to Sasaram Jail, and has now been released from there as also he had been detained on account of production warrants pending against him from various Courts. In view of such a report, this application appears to have become infructuous.

It is dismissed as such.
