The petitioner, who is in custody since 18.09.2019, seeks bail in connection with Piro P.S. Case No. 256 of 2019, dated 17.09.2019, instituted for the offences under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

Patna High Court CR. MISC. No.33506 of 2020(2) dt.16-12-2020 2/3 The prayer for bail of the petitioner was earlier rejected vide order dated 20.02.2020 passed in Cr. Misc. No. 7910 of 2020.

The petitioner is alleged to have been in possession of a country made pistol and cartridges.

The learned counsel for the petitioner has drawn the attention of this Court to the fact that in the three cases in which the petitioner was earlier made accused and about which reference has been made in paragraph 3 of the bail application, he has been granted bail in such cases. Regard being had to the nature of accusation and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Piro P.S. Case No. 256 of 2019.
