Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Kahalgaon(Ghogha) P.S. Case No. 191 of 2022 lodged under Sections 376, 452, 511 of the I.P.C.

As per the prosecution case, there is allegation in the F.I.R. that the accused petitioner entered the house of the informant by jumping wall and tried to commit rape her and also tried to kill the informant. Upon shout, the brother of the informant came out from his room and caught the petitioner and thereafter, the brother of the informant along with villagers took out the petitioner from his house and then petitioner fled away towards the orchard releasing his hand then, F.I.R. has been registered and petitioner was arrested.

He submits that in the case diary, antecedent of the petitioner is clean. He submits that petitioner is in custody since 06.03.2022. Learned counsel submits that from the rejection order of bail passed by Addl. Sessions Judge-I, it is clear that independent witnesses have stated that there was love affair going on between the petitioner and the victim for a long time.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-I, cum Spl. Judge Vigilance (Trap cases), Bhagalpur in connection with Kahalgaon(Ghogha) P.S. Case No. 191 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
