JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-06-2019 The petitioner in the present case is admittedly the wife and Class I legal heir of the deceased Abhay Kumar Pandey whose life was insured under the Postal Life Insurance Policy. Respondent no. 8 is the father-in-law of the petitioner. He had raised certain disputes with regard to the handing over the amount in question to the petitioner as it was his contention that the interest of the minor daughter, Anchal, of the deceased is required to be protected till she attains majority.
At the Bar learned counsel for the petitioner has submitted that he has instruction to say that the entire amount which will be
Patna High Court CWJC No.2766 of 2016(6) dt.25-06-2019 2/2 received from the insurance coverage will be deposited in fixed deposit with a nationalized bank in the name of the minor daughter Anchal. He has further stated that the amount will not be utilized by the petitioner and will be kept safely in the name of minor daughter Anchal till she attains majority.
In the nature of the statements made at the Bar on behalf of the petitioner, learned counsel for the respondent no. 8 submits that he has now no objection if the policy claim amount is released in favour of the petitioner and the petitioner deposits the same with the Bank in the name of minor daughter Anchal within 7 days from the date of receipt thereof.
This writ application is being disposed of taking note of the aforesaid submissions made at the Bar on behalf of the petitioner. Let the amount in question be released forthwith in favour of the petitioner who will deposit the amount in question in the nationalized bank in the name of minor daughter Anchal and shall abide by statements made before this Court on her behalf.
