The petitioner seeks bail in Katihar Rail P.S. Case No. 27 of 2012 registered under sections 328, 379/34 of the Indian Penal Code.
The petitioner is not named in the first information report. Petitioner was arrested but nothing has been recovered from the possession of the petitioner. Petitioner was not put on T.I.P. One Parmanand Mahto made his statement under section 164 Cr.P.C. that from possession of petitioner the stolen mobile was recovered and that was sold to him. It appears that petitioner is not owner nor named in the first information report and nothing was recovered from the possession of the petitioner. Considering the aforesaid facts, the above

No.42002 of 2014 (3) dt.09-02-2015 2/2 named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Rail Judicial Magistrate, Katihar in Katihar Rail P.S.
