Mrs. Shaheen Begum, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 22-07-2026 Heard learned counsel for the petitioner and learned APP for the State. Perused the case diary.

2. The petitioner seeks bail in connection with Routa P.S. Case No. 307 of 2025 instituted for the offences under Sections 103(1), 109, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. Prosecution case, in short, is that the accused persons allegedly entered the informant's house and brutally assaulted his children with a sharp-edged weapon, resulting in the death of Gulnaz and Inayat and causing injuries to Muskan.

4. Learned counsel for the petitioner submitted that the petitioner is innocent and has falsely been implicated in the present case merely on the basis of suspicion. Learned counsel

Patna High Court CR. MISC. No.31986 of 2026(4) dt.22-07-2026 2/3 for the petitioner submitted that general and omnibus allegation has been made against the petitioner. There is no eye-witness to the occurrence. No incriminating article has been recovered from the conscious possession of the petitioner. Learned counsel further submitted that petitioner is being dragged in this case merely because he is the uncle of the petitioner and there is land dispute between the parties. It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.12.2025 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner stating that the petitioner committed the murder of the two children of the informant and also assaulted the other daughter of the informant, namely, Muskan who disclosed that the petitioner committed the alleged crime. He further contended that several witnesses have supported the case of the prosecution. Learned APP, therefore, prays that petitioner may not be released on bail.

6. Considering the aforesaid facts and circumstances of the case, there being ample material against the petitioner to show his involvement in the murder of the two children of the informant, this Court is not inclined to grant bail to the petitioner at this stage.
