The petitioner seeks bail in anticipation of his arrest in connection with Vaishali Town P. S. Case No. 433 of 2017 dated 28.06.2017 instituted for the offences under Sections 498(A), 506, 354 and 34 of the Indian Penal Code. The petitioner is the younger brother of the husband of the informant.

Learned counsel for the petitioner has submitted that deliberately, the present case has been lodged by the informant at the instance of her husband, who is the brother of the petitioner.

No.76836 of 2018(2) dt.21-12-2018 2/2 It has been pointed out before this Court that earlier with respect to the partition of the family property, the husband of the informant had attacked his own father i.e. the father of the petitioner and in the aforesaid case, the husband of the informant has been convicted and he is presently in jail.

Regard being had to the aforesaid background facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hazipur in connection with Vaishali Town P. S. Case No. 433 of 2017, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
