The petitioner seeks anticipatory bail in connection with Sirdalla P.S.Case No. 27 of 2016, registered for offences punishable under Sections 447, 341, 323, 324, 504, 307 of the Indian Penal Code and 27 of Arms Act.

As per F.I.R., allegation against the petitioner is that the petitioner assaulted and fired on the informant, causing injury.

Submission of the learned counsel for the petitioner is that no firearm injury made by the petitioner, which appears from Annexure-3 and there was free fight between the parties. It is further submitted that there is a case and counter case between the parties and the petitioner has clean antecedent. Learned A.P.P. opposes the prayer for bail.

No.76080 of 2018(3) dt.29-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Sirdala P.S.Case No. 27 of 2016, to the satisfaction of learned A.C.J.M.-V, Nawada, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
