JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-04-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. C-1/63 of 2014, disclosing offences under Sections 420, 468/34 of the Indian Penal Code. Allegation against the petitioner is that the petitioner and one Chhotan Rai approached the complainant, who was desirous to purchase a land and given Rs.3,75,000/- to the petitioner in the year 2014 for preparing an agreement, but thereafter on one plea or another, the petitioner is not executing the sale-deed and even not returning the money. Submission of learned counsel for the petitioner is that he has not taken money, rather one Chhotan Rai has taken the money and as a matter of fact the complainant has not paid

Heard learned A.P.P. as well as learned counsel for the opposite party no.2, who has drawn my attention towards the impugned order that Chhotan Rai has been granted provisional bail for a period of three months with the condition that within that period, he shall execute the sale-deed, but he is executing the sale-deed and not returning the money.
Having heard both sides, in view of the facts and circumstances of the case as stated above, I am not inclined to grant anticipatory bail to the petitioner.
Accordingly, this application is dismissed.
