The petitioner is in custody since 1-6-2014 for the offences punishable under sections 467 and 380/34 of the Indian

Patna High Court Cr.Misc. No.42900 of 2014 (3) dt.21-01-2015 2 / 3 Penal Code.

It is submitted that the F.I.R. was lodged against unknown. In course of investigation the name of the petitioner has appeared in the confessional statement of the co-accused and on the basis of the confessional statement made by him before the police, the stolen mobile has been recovered from his possession. It has been further submitted that Santosh Nut whose name has also appeared in the confessional statement of co-accused, has already been granted bail by this Court-vide Cr.Misc. No. 41751 of 2014.

The learned counsel for the State submits that no recovery was made from the possession of co-accused Santosh Nut, but there has been recovery of stolen mobile from the possession of the petitioner after his confessional statement. The petitioner has also criminal antecedent. The learned counsel for the petitioner submits that the petitioner will co-operate in the trial.

Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sikrahna at Motihari(East Champaran) after framing of charge with the

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the court.
