Petitioner is apprehending his arrest in connection with Kadirganj P.S. Case No. 50 of 2018 registered for the offences punishable under Section 498 (A)/34 of Indian Penal Code pending in the Court of Judicial Magistrate 1st Class,Masaurhi, Patna.
It is submitted that he has falsely been implicated in this case and that there is no specific allegation against the petitioner. It is also submitted that both the informant and the petitioner have been married twice and the allegations do not inspire any confidence.
Without going into the allegation made in the FIR, this Court would observe that there is specific allegation against
Patna High Court Cr.Misc. No.75304 of 2018(2) dt.19-12-2018 2/2 the petitioner of assaulting and harassment against the informant. Petitioner being husband cannot absolve from his responsibilities in respect of the informant. Considering the aforesaid facts and circumstances, this Court is not inclined to allow the prayer for anticipatory bail of the petitioner. The prayer is therefore, rejected.
