The petitioner apprehends his arrest in a case registered for the offence under Sections 307, 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act. As per F.I.R., eight accused persons including petitioner made indiscriminate firing on the informant, but it did not hit him, rather firing made by co-accused Kallu Miya hit Md. Mainul Haque, who during course of treatment succumbed to the injury. It is further alleged that co-accused Pappu and Tannu caused gun shot injury to one Md. Taj and while fleeing away one of the co-accused Aftab was apprehended on spot. It is further alleged that co-accused Shakil and Md. Niyaj are alleged to be conspirators of this case.

Specific accusation of firing is against other co-accused persons. Petitioner has got clean antecedent Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VI, Patna City (Patna) in connection with Sultanganj P.S.
