The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, a total of 2224.930 litres of IMFL was recovered from the rooms made on Government land and it is stated that the five named accused persons who had kept the same, managed to escape. It is submitted by learned counsel for the petitioner that a supplementary affidavit has been filed on behalf of the petitioner stating about the urgency in taking up the case being that the father of the petitioner died on 5.11.2021. The allegations against the petitioner are false and concocted. He was not caught at the place of occurrence. The cause of his false
Patna High Court CR. MISC. No.43241 of 2021(2) dt.22-11-2021 2/2 implication is an earlier case under the Bihar Prohibition and Excise Act against him. He is in custody since 4.2.2021 and other coaccused namely Rahul Kumar and Tinku Yadav have been enlarged on bail, orders of which have been brought on record as annexures to the supplementary affidavit. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case, the Court directs the petitioner to be enlarged on bail in connection with Special Case no.6305 of 2020 arising out of Rupaspur P.S. Case no. 362 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna.
