2. Petitioner seeks regular bail in connection with Sessions Trial No. 58 of 2025 arising out of Barhiya P.S. Case No. 140 of 2016 dated 07.08.2016 registered for the offences punishable under sections 304B and 201 read with section 34 of the Indian Penal Code.

3. The main submissions advanced by petitioner's counsel are that the petitioner is a lady having relationship with the deceased as of gotni (wife of elder brother of the husband of the deceased) and in the FIR, there is no specific allegation against her with regard to the alleged dowry demand as well as on other aspect of the allegations and the petitioner's husband has also been made accused in this matter with the same

No.32912 of 2025(3) dt.06-08-2025 2/2 allegation and he has been granted bail by the then co-ordinate bench of this Court vide order dated 15.11.2017 and three other co-accused persons, namely, Sanjay Pathak, Nagi Singh and Ramanuj Singh have also been granted anticipatory bail by the then different benches of this Court vide orders passed in Cr. Misc. Nos. 7144/2017 and 41839/2016 respectively, so, the case of this petitioner stands on better footing from them as she is a lady and presently, she is languishing in jail for about six months. It is lastly submitted that the husband of the deceased is in judicial custody.

4. Learned APP for the State has opposed the prayer of the petitioner.

5. Considering the aforesaid submissions made by petitioner's counsel, this Court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Sessions Trial No. 58 of 2025 arising out of Barhiya P.S. Case No. 140 of 2016.
