JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2019 This is an application for grant of anticipatory bail in connection with Saraiya P.S. Case No. 225 of 2018, disclosing offences under Sections 341, 323, 314, 316, 302, 504, 506/34 of the Indian Penal Code.
Allegation as per F.I.R. is that the petitioners including the other accused persons have came to the house of the informant and abusing him and assaulted Golu Kumar with lathi and danda and when the informant and his wife came to rescue, they have also assaulted by the accused persons and accused Badri Thakur strike with a lathi on the abdomen of Sobha Devi, due to which she received injury and later on succumbed to the injury.
Submission of learned counsel for the petitioners is
Patna High Court Cr.Misc. No.78521 of 2018(3) dt.31-01-2019 2/2 that they are not the assailant of the deceased and no specific allegation has been attributed against them.
Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the petitioners stating that charge-sheet has been submitted in this case and they have shown absconder.
Having heard both sides, considering the above facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners.
Accordingly, this application is dismissed.
