====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-08-2024 Heard learned counsel for the petitioner and Mr. Umeshanand Pandit, learned A.P.P. for the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 8, 15(C), 18, 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act.

3. As per prosecution case, 50 kg poppy dust was recovered from pick-up vehicle.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner. Petitioner had no knowledge about the nature of articles and was simply following the instructions of owner.

5. Learned A.P.P. for the State opposed the prayer for bail and submits that petitioner is driver of the pick-up van in

Patna High Court CR. MISC. No.35742 of 2024(4) dt.28-08-2024 2/2 question.

6. Considering the huge quantity of recovery of doda and petitioner being driver of the vehicle, prayer for anticipatory bail of the petitioner is refused.
