This application for regular bail arises out of Bihariganj P.S. Case No. 231 of 2019, disclosing offences punishable under Sections 302/34 of the Indian Penal Code. The deceased was the informant's son. It is alleged that the deceased was killed by his in-laws including his wife because of continuing serious matrimonial dispute between the deceased and his wife. The petitioner is father-in-law of the deceased.

Learned counsel appearing on behalf of the petitioner has submitted that the wife of the deceased and mother-in-law of the deceased have been allowed regular bail by this Court by orders dated 05.02.2020 passed in Cr. Misc. No. 6597 of 2020

Patna High Court CR. MISC. No.31537 of 2020(3) dt.06-01-2021 2/2 and 19.03.2020 passed in Cr. Misc. No. 86834 of 2019. He has submitted that involvement of this petitioner and other accused persons is merely based on suspicion.

On perusal of the materials on record, I find substance in the submission made on behalf of the petitioner. This application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Uda-Kishunganj, Madhepura in Bihariganj P.S.
