JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-08-2022 The present writ petition has been filed for release of the retiral dues of the husband of the petitioner, who retired from the service of Ramadhin College, Sheikhpura w.e.f. 31.08.2020, however, he is now bedridden on account of illness. The learned counsel appearing for the Munger University has submitted that 90% pension, 90% gratuity and 90% leave encashment amount has already been paid. It is

Though, the learned counsel for Munger University has submitted that 10% amount of pension, gratuity and leave encashment would be paid after pay verification is carried out by the State Government, however, at this juncture, the learned counsel for the State has submitted that the pay verification has already been done and sent to the University. In such such view of the matter, the learned counsel for the Munger University submits that balance amount shall be paid immediately. As far as the amount of G.I.S. is concerned, it has been submitted that immediately upon the documents being received from the Bhagalpur University, the same shall be paid, to which the learned counsel for the Bhagalpur University submits that the needful would be done within a week.
Accordingly, the present writ petition stands disposed of with the following directions:- (I) The Vice- Chancellor, Munger University shall ensure payment of the 10% pension, 10% gratuity and 10% leave encashment amount within a period of two weeks from today, failing which she shall not draw her salary.
Patna High Court CWJC No.13474 of 2021(5) dt.04-08-2022 3/3 send the details regarding G.I.S. in order to enable the Munger University to make payment of G.I.S. amount within a period of one week from today, failing which the Vice-chancellor shall not draw his salary.
(III) Consequently, the Vice Chancellor, Munger University shall ensure that the Insurance amount is paid within a period of four weeks from today.
The writ petition stands disposed of on the aforesaid terms.
