1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 379, 427, 504, 506/34 of the Indian Penal Code.

3. The learned counsel for the petitioners submits that the petitioners have antecedent of two cases and have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation, as alleged in the F.I.R., it would manifest that specific allegation of assault is against Kanhaiya Yadav who is alleged to have assaulted by rod

No.36572 of 2024(2) dt.25-06-2024 2/2 causing fracture of the hand of the informant and Sanjay Yadav is alleged to have assaulted by iron rod causing injury on head of the informant and as far as these petitioners are concerned, the allegation against them are general and omnibus in nature of assaulting the informant. It is next submitted that allegation of snatching Rs. 40,000/- from the pocket along with golden chain is ornamental. It is next submitted that the petitioner No.2 is woman.

4. Learned A.P.P. opposes the bail application.

Consideration the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below withing a period of six weeks, are directed to be released on bail on furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Ist, Sheikhpura, in connection with Ariyari P.S. Case No. 82 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

6. The applications stands allowed.
