2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 140(3), 305, 351(2), 352(3) (5) of the BNS.
3. The case of the prosecution is that the petitioner kidnapped the wife of the informant with an intention of usurping the money of about 40,00,000/- It is alleged that the the petitioner has also taken away cash amount to Rs. 44,00,000/- which was kept in his house.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that from perusal of the FIR, it is clear that the occurrence is of
Patna High Court CR. MISC. No.31613 of 2025(2) dt.16-05-2025 2/2 19.09.2024 whereas the FIR has been lodged on 13.12.2024 for which there is no explanation on behalf of the informant. It is also submitted that from Annexure P/2, it would transpire that Chandni Kumari has also filed a complaint petition against the informant regarding subjecting her to cruelty on account of nonfulfillment of demand of dowry. It is further submitted that this case seems to be a counter blast of that case. Moreover, the petitioner is languishing in judicial custody since 16.02.2025 having no criminal antecedent.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Asarganj P.S. Case No. 169 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-1st, Munger.
