Petitioner seeks bail in a case registered for offences punishable under Sections 341, 323, 337, 338, 302, 504/34 of the Indian Penal Code.
As per the allegation, the death had occurred due to the alleged stone pelting from the roof due to which the father of the informant had sustained injuries on his head and had died. It is submitted that there is no specific allegation that the petitioner is responsible for the death rather the allegation of brick-batting is general and omnibus upon all the three accused persons. It is further submitted that two of the accused persons, namely, Santosh Sao and Vijay Sao, have already been granted bail by this Court vide Annexure 3. The petitioner is stated to be in
Patna High Court Cr.Misc. No.48628 of 2014 (2) dt.04-03-2015 custody since last more than a year.
Having regards to the facts and circumstances of the case, the petitioner, namely, Anandi Sao is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge IV, Jamui , in Sikandra P.S. Case No. 70/2013 dated 29.03.2013 S.T. No. 555/13.
