JUSTICE PARTHA SARTHY ORAL ORDER 08-12-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The instant application for regular bail has been filed by the petitioner in connection with Brahampur (Chakki O.P.) P.S. Case No.305 of 2020 registered under sections 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per allegation in the FIR, 50 litres of country liquor was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that the allegation of recovery is false and concocted. No recovery whatsoever has taken place from his possession. He is in custody since 14.6.2020.
The application for bail is opposed by learned APP
Patna High Court CR. MISC. No.32843 of 2020(2) dt.08-12-2020 2/2 for the State who submits that the petitioner has one another case under the Excise Act pending against him. Having heard learned counsel for the parties and taking into consideration the period in custody, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Brahampur (Chakki O.P.) P.S. Case No.305 of 2020 on his furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge 2nd -cum-Special Judge, Excise, Buxar.
