JUSTICE MADHURESH PRASAD ORAL ORDER 02-04-2019 In view of the averments made in para 17 of the counter affidavit, petitioner's Counsel is permitted to implead Special DG, Central Zone, CRPF, Kolkata as party respondent No. 6 to the instant writ petition.

Submissions have been made by petitioner's Counsel that the petitioner under compelling circumstances had absented from training during the course of his probation. He accordingly submits that an appeal seeking mercy of the Director General of the Force has been filed which is Annexure 8 to the writ petition.

Patna High Court CWJC No.15570 of 2015(3) dt.02-04-2019 2/2 In the counter affidavit the respondents have averred that the mercy appeal has been forwarded to the Special DG, Central Zone, CRPF, Kolkata by the Inspector General of Police, Bihar Sector CRPF, Patna on 31.10.2015. In spite of such forwarding for disposal the same has not been disposed of. In view of aforesaid pendency of the mercy appeal this Court would refrain from making any comment on the merits of the claim of the petitioner. The Director General, Central Zone, however, is obliged to dispose of the mercy appeal by a reasoned and speaking order in accordance with law within a period of three months from the date of receipt/production of a copy of this order.

The writ petition stands disposed of.
