JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-03-2019 This application, for grant of anticipatory bail, arises out of Nautan P.S. Case No. 403/18, disclosing offences under Sections 147, 148, 149, 323, 324, 307, 332, 338 and 353 of the Indian Penal Code.
Allegation against the petitioners and others is of attacking on the police party.
Submission of learned counsel for the petitioners is that they have falsely been roped in the present case at the instance of the police and further with respect to same occurrence, two cases have been lodged, one is the present one and another being Nautan P.S. Case No. 402 of 2018, in which, petitioners have already been granted the privilege of
Patna High Court CR. MISC. No.79521 of 2018(3) dt.01-03-2019 2/2 anticipatory bail by a coordinate Bench of this court vide order dated 17.12.2018 passed in Criminal Miscellaneous No. 66675 of 2018.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Nautan P.S. Case No. 403/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
