The petitioners seek regular bail in connection with Chandramandi P.S. Case No. 94 of 2020 for the offence registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

The allegation is regarding recovery of huge quantity of illicit liquor from a truck. The petitioners are stated to be the driver and cleaner of the said truck.

The learned counsel for the petitioners has submitted that the petitioners are innocent, have been falsely implicated in the present case, are having a clean antecedent and they are languishing in custody since 16.07.2020. The learned counsel for the petitioners have further submitted that the petitioners are

Patna High Court CR. MISC. No.37966 of 2020(2) dt.05-02-2021 2/2 not the owner of the truck in question, hence they were not aware of the goods loaded in the said truck. Per contra, the learned counsel for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioners and taking into account the materials on record as also considering the fact that the petitioners are the driver and cleaner of the truck in question and are having a clean antecedent apart from the fact that they are languishing in custody since 16.07.2020, I deem it fit and proper to direct for release of the petitioners herein on regular bail.

Accordingly, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of 2nd Additional District and Sessions Judge, Jamui, Bihar in connection with Chandramandi P.S. Case No. 94 of 2020.
