Ms. Asha Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 26-06-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Jehanabad (Sikariaya OP) P.S. Case No. 947 of 2023, instituted under Sections 323, 379, 457, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, on the date of occurrence at 9 P.M. petitioner entered into the house of informant and started dragging the informant and her daughter. When son of the informant came to save, the petitioner assaulted her son and daughter. He began to press their neck. It is alleged that the petitioner took away her valuables and cash of Rs. 10,000/-. When the father-in-law of the informant went to complain to the house of petitioner, his family members threatened to kill them.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.38498 of 2024(2) dt.26-06-2024 2/2 petitioner has falsely been implicated in this case as there was dispute between the parties with respect to loan amount. There is inimical term between the parties and earlier also informant had filed a criminal case against the petitioner in which petitioner is on bail and to pressurize the petitioner, informant has again filed case making false allegation against him. There is no injury caused to the informant's side. He undertakes to co-operate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court where the case is pending in connection with Jehanabad (Sikariaya OP) P.S. Case No. 947 of 2023, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure, 1973. (Sunil Dutta Mishra, J) rakhi/- U T
