2. The petitioner seeks bail in a case registered for the offence punishable under Sections 126(2), 115, 117, 109, 61, 190 of the B.N.S. and Section 27 of the Arms Act.
3. The allegation in the First Information Report is that the accused persons including the petitioner are said to have assaulted the informant's son brutally with an intention to kill him. The injured was left in a critical condition in a semi constructed house of one of the accused Bittu Kumar.
4. Learned counsel for the petitioner submits that there are general and omnibus allegations against all the accused
Patna High Court CR. MISC. No.33019 of 2025(2) dt.26-05-2025 2/3 persons and there is no specific allegation against the petitioner. Further, there is no eye witness to the alleged incident and the name of the petitioner has transpired in the present case merely on the basis of a suspicion that earlier they were involved in an altercation with the deceased. The petitioner is in custody since 21.01.2025 and the attention of this Court has been drawn towards the fact that two of the accused persons Tulshi Yadav and Banti Chaudhary have been granted privilege of anticipatory bail vide orders dated 14.02.2025 and 23.10.2024 passed in Cr. Misc. No. 9746 of 2025 and Cr. Misc. No. 71124 of 2024 respectively. Further, it has also been pointed out that co-accused Bittu Paswan has also been granted bail vide order dated 05.05.2025 passed in Cr. Misc. No. 26832 of 2025.
5. Learned APP for the State has opposed the application for bail.
6. Having regards to the facts and circumstances that there is no eye witness to the occurrence and other similarly situated co-accused persons have been granted bail, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection
