The petitioner seeks bail in Konch P.S. Case No. 116 of 2020 corresponding to POCSO Case No. 44 of 2020, registered for the offence punishable under Sections 342, 354, 504, 506, 34 of the Indian Penal Code and section 7 of the POCSO Act.

As per the prosecution case, daughter of informant aged about 5 years went to the house of petitioner for watching television. After one hour, during course of search, informant went at the house of petitioner and saw that petitioner was kissing her daughter.

It is submitted on behalf of the petitioner that petitioner is next door neighbour of the informant. There is land dispute between the parties that is why this petitioner has falsely

Considering the facts and circumstances of the case and clean antecedent of the petitioner, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge VII-cum-Exclusive Special Court (POCSO Act), Gaya in connection with Konch P.S. Case No. 116 of 2020 corresponding to POCSO Case No. 44 of 2020.
