Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sarai P.S. Case No. 331 of 2021 lodged under Sections 366(A)/34 of the I.P.C.

As per prosecution case, the maternal grand mother of the victim lodged this case against 6 known accused persons with allegation of kidnapping to her maternal grand daughter alongwith jewelleries and cash.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Counsel further submits that petitioner is a man of clean antecedent and

He further submits that the recovery of the alleged victim has taken place and after recovery in her statement under Section 164 Cr. P.C. she has not alleged any wrong against the present petitioner rather he has narrated that she herself went to the house of relatives. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XVI, Vaishali in connection with Sarai P.S. Case No. 331 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.. With this observation, the bail application stands allowed.
