The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 365/368 of the Indian Penal Code.
As per the prosecution case, petitioner and other accused persons came to the house of the informant and called her son on telephone and when he came out of the house, the accused persons on the point of pistol kidnapped him using Scorpio vehicle.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. FIR has been lodged after delay of 11 days and there is no explanation of delay. The victim in his statement recorded
Patna High Court CR. MISC. No.43918 of 2021(4) dt.03-02-2022 2/2 under section 164 Cr. P. C. has not alleged anything against the petitioner rather he has made allegation that it was co-accused Nitish, his co-villager, who made call on his phone and thereafter 4/5 other accused persons had kidnapped him. Petitioner has claimed clean antecedent and he is in custody since 5.4.2021.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul in Supaul Police Station Case No. 313 of 2020.
