The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 353 and 427 of the I.P.C.

The prosecution case as per the written report of Basant Kumar Singh dated 11.06.2018 submitted to the Officerin-Charge, Chhatauni Police Station is to the effect that when the informant along with SHO, Chhatauni and other police officials went to remove encroachment in pursuance to the order passed in Encroachment Case No.1 of 2017-18, then the petitioner along with other hundred persons pelted stones and also damaged the JCB machine.

Patna High Court Cr.Misc. No.76192 of 2018(2) dt.17-01-2019 2/2 It is submitted by the learned counsel for the petitioner that the accusation against the petitioner is omnibus and general in nature. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

It is submitted by the learned APP for the State that the petitioner is named in the FIR.

Considering the fact that the accusation is against the mob, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bonds of Rs. 10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran in connection with Chhatauni P.S. Case No.157 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
