====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-12-2020 Heard the learned counsel for the petitioner and the State.

The petitioner seeks bail in connection with Excise Case No. 809 of 2020, arising out of Koilwar P.S. Case No. 230 of 2020 dated 11.06.2020 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears from the prosecution report that from the maize field of the petitioner 74.540 litres of liquor was recovered.

Learned counsel for the petitioner submits that the recovery is from an open place, accessible to all and sundry.

He is in custody since 12.06.2020 and is a person of clean antecedent.

Patna High Court CR. MISC. No.34588 of 2020(2) dt.22-12-2020 2/2 Regard being had to the aforestated facts, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Additional District and Sessions Judgecum-Special Judge, Excise, Bhojpur, Ara in connection with Excise Case No. 809 of 2020, arising out of Koilwar P.S. Case No. 230 of 2020.
