Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Patrakar Nagar P.S. Case No. 79 of 2022 lodged under Sections 25(1-B)a/26/35 of Arms Act.

As per prosecution case, the F.I.R. has been filed by the police authority in which it has been alleged that the police were on routine patrolling, an announcement was going on from the control room that loot has been made and two persons wearing white jacket were there and both two persons including the petitioner started fleeing away on seeing the patrolling car. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He also submits that there is only one case pending against the petitioner in which he is on bail. Learned counsel further submits that petitioner is in custody since 18.02.2022 and charge-sheet has already been filed in this case.

Learned counsel for the State opposes the prayer for bail and submits that the looted mobiles have been recovered from the possession of the petitioner.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner, therefore, his bail petition is hereby rejected. The Trial Court is directed to conclude the trial within 9 months.
