2. The petitioner seeks bail in connection with Barachatty P.S. Case No. 441 of 2025 instituted for the offences under Sections 103(1), 238, 61, 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. Prosecution case, in short, is that the informant alleged his uncle, Arjun Turi, went to purchase groceries on 14.12.2025 but did not return. The next day, his dead body was found near a Konar tree. As there had been an altercation between the deceased and the petitioner along with three others about 15 days earlier, the informant suspected that they had murdered him by strangulation and assault with a sharp-cutting

Learned counsel for the petitioner submitted that the petitioner is innocent and has falsely been implicated in the present case merely on the basis of suspicion which is evident from the FIR itself. Learned counsel for the petitioner submitted that general and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. He further contended that informant is not the eye-witness to the alleged occurrence and nor any eye-witness has come forward to support the prosecution case. During course of investigation, the petitioner was arrested and his confessional statement was recorded in which he disclosed that co-accused Bhola Turi pressed the neck of the deceased by clutch wire due to which the deceased died. It has been submitted on behalf of the petitioner that the petitioner is in custody since 02.03.2026 and has no criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, there being no direct allegation against the petitioner as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- ( Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Barachatty P.S. Case No. 441 of 2025.
