The petitioners are apprehending their arrest in connection with Udawant Nagar P.S. Case No.347 of 2018, Excise Case No.1486 of 2018 registered for offences punishable under Sections 30(a), 37(c) of Bihar Prohibition and Excise Act, 2016.
From the possession of the petitioner, 25 litres of illegal Mahua liquor has been recovered and co-accused persons disclosed the name of the petitioner.
Submission of learned counsel for the petitioners is that there is no recovery made from the petitioner and he has no criminal antecedent.
Patna High Court Cr.Misc. No.1723 of 2019(2) dt.01-02-2019 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of receipt/ production of a copy of this order, be released on bail upon furnishing bail bond of Rs.25,000/-(Rupees Twenty Five thousand) each with two sureties of the like amount each to the satisfaction of the learned 4th Additional Sessions Judge-cum-Special Judge, Excise, Bhojpur at Ara in connection with Udawant Nagar P.S. Case No.347 of 2018, Excise Case No.1486 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
