The petitioners seek bail in connection with Pusa P.S. Case No. 46 of 2020 instituted for the offence under Section 30(a) of the Bihar Prohibitiion and Excise Act, 2016. 81.690 litres of liquor is said to have been

Patna High Court CR. MISC. No.36513 of 2020(2) dt.01-02-2021 2/2 recovered from a vehicle which was occupied by the petitioners and another. The petitioners are said to have been arrested on chase.

It has been submitted on behalf of the petitioners that the liquor which has been seized does not belong to them and they had no idea that the seized item was kept in the boot of the car.

The petitioners are stated to be in custody since 17.07.2020.

Considering the facts afore-stated and taking into account the period of custody of the petitioners, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge-Cum-Special Judge, Excise-II, Samastipur in connection with Pusa P.S. Case No. 46 of 2020.
