29-10-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in G.R. No. 1499 of 2021 (arising out of Sono P.S. Case No. 132 of 2021), registered for the offence under Sections 272/273 of the Indian Penal Code and Sections 30(a)/41 of Bihar Prohibition and Excise Act. 190 liters & 500 ml of foreign liquor has been recovered from a Scorpio vehicle and this petitioner, who was sitting in the vehicle, was apprehended on spot. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the vehicle in question and he was simply a co-passenger. Petitioner has got clean antecedent and he is in custody since 05.06.2021. Investigation is complete.

Patna High Court CR. MISC. No.42950 of 2021(2) dt.29-10-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation, period of custody and clean antecedent of the petitioner, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge 2nd, Jamui in connection with G.R. No. 1499 of 2021 (arising out of Sono P.S. Case No. 132 of 2021).
