At the very outset, learned counsel for the petitioner submits that due to mistake one more criminal antecedent has not been mentioned in paragraph no.3 of the bail petition.

The petitioner seeks bail in connection with Beldour P.S. Case No.51 of 2023 registered for the offence under Section 341, 323, 307, 504, 506, 34 of the Indian Penal Code and under Section 27 of the Arms Act.

The accused persons including this petitioner are said to have assaulted and have fired at the victim, who has sustained one bullet injury.

It has been submitted by the learned counsel for the petitioner that the occurrence has taken place because of

Patna High Court CR. MISC. No.35942 of 2024(2) dt.21-06-2024 2/2 land dispute and the petitioner is in custody since 08.06.2023. No specific allegation of assault or firing has been attributed against the petitioner.

Considering the aforesaid facts, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, in connection with Beldour P.S. Case No. 51 of 2023.

As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Pasraha Police Station on every Sunday of the month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) pawan/- U T
