JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-02-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 25.11.2020, within four weeks of starting of the Court proceeding in physical mode.

Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Matihani P.S. Case No.117 of 2017 registered under Sections 326 and 307/34 of the Indian Penal Code besides Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that, earlier, the prayer of the petitioner for grant of bail was rejected by this Court vide order dated 19.03.2020 passed in

Patna High Court CR. MISC. No.31817 of 2020(2) dt.03-02-2021 2/2 Criminal Misc. No.75022 of 2019 with an observation that the petitioner would be at liberty to renew his prayer for bail after completion of one year in incarceration. The petitioner is in incarceration since 02.09.2019, i.e., for more than one year. Having regard to the facts and the circumstances of the case and considering the observation made by this Court in the order dated 19.03.2020 passed in Criminal Misc. No.75022 of 2019, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Matihani P.S. Case No.117 of 2017/GR No.2545 of 2017.
