No. 1 of 2019 This Interlocutory Application has been filed for amendment of para 1 of the anticipatory bail petition by way adding Section 302 of the Indian Penal Code which was not mentioned in the main petition.

2. Having regard to the nature of the prayer, the interlocutory application is allowed and the same shall be treated to form part of the petition.

3. The petitioners apprehend their arrest for the offences alleged under Sections 147, 148,149, 341,323, 307,504 and 506 IPC registered in connection with Hussainganj P.S. Case No. 282 of 2018.

4. It is submitted that the petitioners have been falsely implicated in the backdrop of dispute between the children of the parties. It is submitted that specific accusation of assault has been made against coaccused Vanila Sah along with Anil Sah who are said to have assaulted the deceased Sunil Kumar Prasad with iron rod on his head. The accusation of assault against the petitioners are general and omnibus in nature. The petitioners claim clean antecedents.

5. Learned APP assisted by learned counsel for the informant opposes the anticipatory bail petition. It is submitted that all the accused persons are said to have committed assault upon the deceased. It is submitted that co-accused Uttam Sah against whom similar accusation has been made has been denied anticipatory bail by this Court in Cr. Misc. No. 6538 of 2019.

6. Having regard to the nature of accusations and gravity of offence alleged, this Court is not inclined to grant the privilege of anticipatory bail to the petitioners. The petition stands dismissed. (Vikash Jain, J) Chandran/BT U T
