JUSTICE SHIVAJI PANDEY ORAL ORDER 12-01-2021 Heard learned counsel for the petitioner and the State. In the present case, the petitioner is seeking bail in connection with Sessions Trial No. 89 of 2020 arising out of Dhoraiya P.S. Case No.36 of 2018 registered for offences punishable under Sections 302, 201, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation has been made in the FIR that in the night, four persons, namely, Mann Mandal, Guddu Mandal, Chandan Bhagat and Panna Das (the present petitioner) came to the house of the Informant on motorcycle and took away her husband and later on, his dead body was recovered. A suspicion has been raised against other 13 persons with whom her husband had a land dispute.

Counsel for the petitioner submits that earlier the

Patna High Court CR. MISC. No.31611 of 2020(3) dt.12-01-2021 2/2 petitioner had filed a Cr. Misc. No. 61660 of 2019 for grant of bail, which was rejected by this Court vide order dated 20.11.2019 with a liberty to renew his prayer for bail after one year of his judicial custody and now the petitioner has completed more than one year of his judicial custody as he is in judicial custody since 6.07.2019. It is urged that similarly situated co-accused persons have already been granted bail by a coordinate Bench of this Court vide Cr. Misc. Nos. 1627 of 2020 and 85791 of 2019.

Considering the entire facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-1, Banka in connection with Sessions Trial No. 89 of 2020 arising out of Dhoraiya P.S. Case No. 36 of 2018 with a condition that one of the bailor will be the close relative of the petitioner and he will cooperate in the trial.
