Case no. 22/2014 registered under sections 147, 148, 149, 302 of the IPC and 27 of the Arms Act and accordingly, both the above stated petitions are being disposed of by this common order. Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.
In Cr. Misc. no. 33905/2014, I think it proper to peruse post
Patna High Court Cr.Misc. No.33905 of 2014 (3) dt.19-01-2015 mortem report of the deceased but the same has not been sent by the court below along with the case diary.
Learned counsel for the petitioner in Cr. Misc. no. 33905/2014 seeks one week's time to bring post mortem report of deceased on record.
So far as the petitioner in Cr. Misc. no. 44510/2014 is concerned, he is not named in the first information report and his name surfaced in this case in confessional statement of the petitioner in Cr. Misc. no. 33905/2014.
Accordingly, petitioner in Cr. Misc. no. 44510/2014, namely, Madan Kumar be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Patnacity in Fatuha P.S. Case no. 22/2014.
