2. The petitioner seeks bail in Jayanagar P.S. Case No. 63 of 2026 registered for the offences under Section 20/22 of the NDPS Act.

3. The allegation is that 10.55 kg of Ganja was recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the alleged recovery is of intermediate quantity and there is absence of bar under Section 37 of the NDPS Act. He further submits that the petitioner is in custody since 08.02.2026 and has no criminal antecedents.

5. Learned Additional Public Prosecutor for the State

Patna High Court CR. MISC. No.33878 of 2026(3) dt.24-06-2026 2/2 has vehemently opposed the prayer for bail of the petitioner.

6. Considering the intermediate nature of the alleged recovery, the absence of any bar under Section 37 of the NDPS Act, and the period of custody undergone by the petitioner, this Court is inclined to grant bail.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Principal Sessions Judge/Concerned Court, Madhubani in connection with Jayanagar P.S. Case No. 63 of 2026.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
