The petitioner seeks bail in Bisfi P.S. Case No. 375 of 2019, registered for the offence punishable under Sections 363, 366(A)/34 of the Indian Penal Code.

As per the prosecution case, this petitioner with the help of co-accused Lal Yadav and Phul Kumari Devi kidnapped the minor daughter of informant.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case case. In fact, the victim girl was having love affair with this petitioner and out of her own will she left her house and went along with this petitioner. The victim girl in her statement under Section 164 Cr.P.C has also supported the same fact and disclosed her age to

Patna High Court CR. MISC. No.42933 of 2021(3) dt.15-11-2021 2/2 be 18 years and also stated that they have solemnized marriage in a temple in Himachal Pradesh. The victim girl has also been medically examined and she was found to be 18 years by the Medical Board. Petitioner is in custody since 27.01.2021. Considering the statement of victim girl recorded under Section 164 Cr.P.C, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Benipatti, Madhubani in connection with Bisfi P.S. Case No. 375 of 2019.
