The petitioner seeks bail in a case under Sections 409/34 of the Indian Penal Code.

The Block Education Officer alleged that the Headmaster of the petitioner's school along with the petitioner and two other teachers distributed less amount of scholarship to the students and thereby misappropriated huge amount. It is submitted that the petitioner is the school teacher. Anwar Alam is the Headmaster of the school and on his instruction, the petitioner distributed the scholarship amount. The petitioner is in jail since 25th of July, 2014 and the other coaccused Sudhir Kumar and Santosh Kumar Mishra have already been enlarged on bail vide order passed in Cr. Misc. Nos. 41020

Patna High Court Cr.Misc. No.45171 of 2014 (3) dt.23-02-2015 and 41607 of 2014. The case of the petitioner stands on similar footing.

Considering the facts aforesaid, petitioner, namely, Asgar Ali @ Aslam Ali is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Harsidhi P.S.
