JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 This application, for grant of anticipatory bail, arises out of Muzaffarpur Sadar P.S. Case No. 761 of 2018, disclosing offences under Sections 341, 354(B), 323, 379 of the Indian Penal Code.

Allegation against the petitioner and others is that they caught hold the hand of the informant and tried to outrage her modesty and on protest made by her, petitioner thrashed her on ground causing injuries to her and when other family members assembled, petitioner and others came and assaulted the sister pf the informant and her brother in law Ranjeet Mahto. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and no such occurrence has ever taken place. It has further been submitted

Patna High Court Cr.Misc. No.77953 of 2018(2) dt.03-01-2019 2/2 that there is land dispute between the petitioner and his brother, namely, Ranjeet Mahto and on the instigation of wife of Ranjeet Mahto, the present false and concocted case has been lodged by the informant.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Muzaffarpur Sadar P.S. Case No. 761 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
