====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 11-03-2022 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. for the State.

Let the defect(s) be removed within two weeks of the complete start of the physical Court in normal course. The petitioner, who is in custody since 04.04.2021, seeks regular bail in connection with Sitamarhi Mahila P.S. Case No. 29 of 2019, for the offence punishable under Sections 323, 376, 504 and 506/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner was married with the informant on 29.06.2020 as per Muslim rite and rituals. He further submits that the petitioner and the informant have entered into the compromise on 08.02.2021. The informant is willing to live with the petitioner. The petitioner is in custody since 04.04.2021.

Considering the aforementioned facts and circumstances of the case, without going into the merits of the case and taking into consideration the submission made by the petitioner as well as

No.44624 of 2021(3) dt.11-03-2022 2/2 statement made in the supplementary affidavit that informant has entered into the compromise with the petitioner on 08.02.2021 and the petitioner keeps the informant, who is his wife with full dignity and honour. The petitioner, above named, is directed to be enlarged on provisional bail, for a period of one year, on furnishing bail bond of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi Mahila P.S. Case No. 29 of 2019 and/or on such terms and conditions which the Court below finds fit and proper.

During the aforesaid period, if the informant has made any compliant against the petitioner then his bail bond shall be cancelled. In case no grievance is made against the petitioner by the informant, the provisional bail shall be confirmed on such conditions as the Court below may deems fit and proper after one year. With the aforesaid observations and directions, this application is disposed of.
