JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-05-2019 Petitioners seek regular bail in connection with Jamui P.S. Case No.51 of 2019 registered for the offences punishable under Sections 147, 148, 149, 302, 120(B), 504 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioners are not named in the F.I.R. and the allegation is that one Subhash Mahton made firing, causing death of son of the informant.

Submission of the learned counsel for the petitioners is that there is general and omnibus allegation against the petitioners and the co-accused persons having similar allegation have been granted bail by a Co-ordinate Bench of this Court vide order dated 10.05.2019 passed in Criminal Misc. No.31355

Patna High Court CR. MISC. No.30862 of 2019(2) dt.23-05-2019 2/2 of 2019. Further submission is that petitioners are in custody since 19.02.2019, having no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioners above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Jamui P.S. Case No.51 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
