The petitioner is apprehending his arrest in connection with Rajauli P.S.Case no.288 of 2017 registered for offences punishable under Sections 3, 4, 5 of the Explosive Substance Act..

Allegation against the petitioner as well as the accused persons is of recovery of 30 pieces of detonators and 30 pieces of liquid explosives .

Submission of the learned counsel for the petitioner is that for the occurrences, two cases have been lodged and in one case the petitioner is on bail and present case is concerned, the seized articles is of Sharda Mines and the petitioner has falsely been implicated in this case.

Heard learned A.P.P. also.

No.79924 of 2018(3) dt.28-02-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.
