The petitioner seeks bail in a case registered for the offence punishable under Sections 25(1-A), 25(1-AA), 25(1-B) AC, 26(i)(ii)(iii) and 35 of the Arms Act.
Allegation against the petitioner and five other named accused is that they were indulged in manufacturing country made arms and during raid two persons including the petitioner were apprehended on the spot.
It is submitted that the petitioner has no criminal antecedent. He had only gone to forest to collect dry wood and during raid he was apprehended. He has been in custody since 15.5.2014.
Patna High Court Cr.Misc. No.44327 of 2014 (2) dt.09-02-2015 2/2 Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Munger/court concerned in Kharagpur (Gangta O. P.) P. S. Case No. 119 of 2014 with following conditions:-
1. The petitioner will not indulge himself in similar or any other offence.
2. One of the bailors must be the close relative of the petitioner.
3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
